1. As a police officer, it sometimes seems “unfair” to preserve and disclose evidence that is favorable to the defense when police are putting together evidence to convict the defendant (California v. Trombetta). Explain the ramifications of this constitutional protection for defendants. Do you agree with it? Why or why not?
2. Two tests are used to determine whether charges brought under different portions of the penal code represent the “same offense.” Explain them and the standard each test uses to determine offense identity. Which test is most prevalent today?
3. The Sixth Amendment guarantees the right to a speedy trial. Explain the policies “the right to a speedy trial” promotes, and why you think they are, or are not, in place in our legal system.
4. Explain in detail the three precautions trial judges traditionally take to counteract the effects of prejudicial media coverage. What are their shortcomings of these precautions? What would you do differently if you were a judge in a high-profile case? Cite a high-profile case to support your writing.
